Location:   A616(T) Barnsley              
 
Offences:   4 offences of exceeding the 60 mph
                  national speed limit.
 
Précis:       The client was prosecuted on four separate        
                  occasions following detection by the
                  SPECS enforcement system whilst driving
                  along the A616(T) towards junction 36 of
                  the M1.
 
                  The client faced a Court hearing on all
                  counts and a mandatory period of        
                  disqualification.
 
Findings:   The national speed limit as with any other    
                  limit of speed has to be provided with lawful
                  signing regardless of the responsible
                  agency.
 
                  Richard Bentley undertook a site
                  examination identified critical areas of the
                  national speed limit that failed to meet the
                  statutory requirements of law.
 
                  Where a highway authority fails in its duty
                  to sign in accordance with Statute, the
                  Court are prohibited from applying a
                  conviction.
 
                  A number of reports were submitted to
                  assist the Court.
 
 Result:      060606  Barnsley Magistrates Court.
 
                  The Crown discontinued the four        
                  prosecutions.  
 
                 An application for costs was made against
                 the Crown.
