Location: A449 Coven Heath, Wolverhampton
Offence: Exceeding a temporary 40 mph speed
restriction.
Précis: Following detected by a mobile speed
camera, the defendant contested the
legitimacy of the limit of speed and
enforcement process.
Findings: Multiple speed limits had been provided
with a single temporary restriction.
A temporary traffic order set the limit at 50
mph yet the signing present on the road
applied a 40 mph restriction.
A number of additional signing issues were
identified including:
1. A lack of repeater signing
2. A national speed limit repeater sign
being present in the restriction
These signing issues rendered the
restriction legislatively unenforceable.
The Camera Partnership whilst accepting
that mandatory signing was not present on
the road then contested the relevance of
such omissions on their enforcement
program.
The Partnership incorrectly informed the
defendant that the signing was correctly
marked and anyway, the provision of
repeater signing is advisory not mandatory.
Result: 050406 Burton on Trent Magistrates Court.
The case was discontinued by the CPS.
An application for costs was made against the
Crown.
