Whose Right?


KiwiPACT is a declaration of mutual understanding between the photographers and visual artists of New Zealand and any commercial organisation that uses or handles images in any media. It has been launched to foster a spirit of co-operation & mutual understanding.


The understanding, symbolised by the use of the KiwPACT logo, acknowledges that there are responsibilities on all sides. Photographers and artists undertake to ensure that clear copyright ownership is attached appropriately; & commercial organisations agree to actively abide by the copyright laws of New Zealand by providing clear guidelines to staff & customers on the handling & use of copyright material.


KiwiPACT exists to educate all parties on the law & practice of copyright. Also, to make it easy to carry out the aims of the understanding by delivering practical guidelines and all necessary collateral material; from terms & conditions for photographers to shop signs for retail outlets. As part of the agreement, all parties agree to abide by the processes outlined for any suspected breach of copyright.


KiwiPACT will not enforce compliance, although anyone who is proven to have deliberately flouted this agreement may be publicly expelled as a signatory. It will not pursue legal claims on anyone’s behalf. Indeed, its purpose it to strive to avoid the necessity of litigation. It does not represent photographers, artists or any commercial body. It is an independent framework to make copyright understood & workable.

When business parties cannot agree on a course of action, it is sometimes necessary to introduce third party mediators to broker an agreement. This picture of Stormont in Northern Ireland symbolises probably one of the greatest mediating endeavours carried out in modern times.

Mediation requires that both parties have a mutually acceptable framework within which to discuss the issue at hand. One contentious legal issue in the media today is copyright. This site sets out to provide a mutually agreeable framework for both creative professionals & commercial organisations to adopt as a Code of Practice
