Glenn Edward Murray, Esq.
Mr. Murray has over 25 years of litigation experience in state and federal courts. His practice emphasizes criminal defense and civil rights and remedies, involving all phases of criminal matters, through investigation, grand jury proceedings and trial. He is listed in Who’s Who in American Law, Who’s Who of Emerging Leaders in America and he is a former Army prosecutor and military defense counsel, who has taught Constitutional Law at Canisius College, and as a frequent guest speaker at the University of Buffalo Law School.
Mr. Murray has been awarded the Martindale-Hubbell Law Directory's highest accolade: an "AV" rating, which places him in the top 11% of American lawyers and Canadian barristers. It signifies his legal abilities are of the highest standards. That rating is based on the result of an extensive, confidential review conducted among the lawyers and judges in his community. His DWI penalty charts and checklists are reproduced in Handling the DWI Case in New York and he is on the editorial boards for two national professional publications: Handling A Criminal Case in New York and Fiandach’s New York DWI Bulletin.
Mr. Murray is a member of the National College for DUI Defense and his criminal DWI successes include: numerous DWI dismissals (unconstitutional checkpoint / speedy trial / insufficient evidence of operation / "Choice of Evils" defense / client’s admitting vehicle operation involved in an accident lacked corroboration / non-specific charges as to alleged DWI crime scene); frequent reduction of criminal DWI charges to noncriminal traffic infractions. In December 2006, he obtained dismissal of a boating while intoxicated (BWI) charge.
His recent criminal defense victories include acquittals and dismissals of numerous felony charges: Aggravated Sexual Abuse (custody dispute reprisal); attempted murder (insanity defense); FBI reverse sting acquittal (defective prosecution theory); drug sale to undercover officer (challenged contradictory evidence); 1st degree assault (impeached complainant); assault (obtained forensic firearm evidence contradicting eyewitness testimony); 1st degree assault (defense of 3rd person); solicitation to commit murder (lack of corroboration); rape (impeached complainant’s testimony); armed robbery (alibi); federal drug conspiracy (impeached informants’ testimony); federal drug distribution (government misconduct defense); federal drug conspiracy jury acquittal (user defense); and dismissal of a zoning violation charge (selective prosecution defense), affirmed by Erie County Court. Not guilty verdicts obtained include charges of:
•Placing a False Bomb - Caledonia Town Court (6/01).
•Attempted Murder / 1st Degree Gang Assault - Erie County Supreme Court (12/04).
•Forgery / Embezzlement - City of Tonawanda Court (1/04).
•Criminal Possession of a Weapon - Buffalo City Court (7/07).
Civil rights accomplishments representing plaintiffs include obtaining:
•judicial declaration (Buffalo Police Department strip-search policy unconstitutional);
•injunction (overcrowding at the County Holding Center unconstitutional);
•appeals ruling by Federal Court of Appeals (amendments to reservist law must be applied retroactively);
•injunction (prohibiting harassment at clinic), with prosecution of violators for contempt; bankruptcy court judgment preventing defendant from avoiding contempt fines via bankruptcy;
•NYS court verdict against police for false arrest;
•US court verdict against corrections officers for violating cruel and unusual punishment clause of constitution;
•judicial declaration by NYS Supreme Court (deed fraudulent and void), with dismissal of counterclaim against Mr. Murray for libel;
•1995 settlement of legal malpractice lawsuit against attorney for failing to perfect military “former spouse” SBP election following divorce.
•2003 settlement of federal Supremacy Clause lawsuit against municipality for refusing to reasonably accommodate the rights of an amateur radio operator to erect radio antenna as guaranteed by FCC regulation PRB-1.
•2004 settlement of lawsuit against client's employer for violating the Uniformed Services Employment and Reemployment Rights Act (USERRA).
•2005 settlement of lawsuit against private investigator for violating the Electronic Communication Privacy Act (ECPA).
•2006 settlement of lawsuit against client’s former employer for racially motivated wrongful termination.
Success in the appellate courts includes:
•Winning an appeal in New York's highest court (The Court of Appeals) to void a criminal conviction of criminal mischief.
•Reversing (voiding) a pre-trial dismissal of a civil lawsuit, arising from the alleged misconduct of a notary public, who caused damage to Mr. Murray's commercial client, the plaintiff in the lawsuit, Stride Rite Children's Group, Inc.
